Fear.

I had an interesting conversation with Czesław, a man who voted for the PiS party in the last election. He said that now he fears he made a mistake. The fear arises from the latest  new legislation adopted by the Polish parliament yesterday that may result in ending the independence of judiciary in the country.

This puts rights and freedoms in Poland at great risk. The right to a fair trial is one of the key requirements of international human rights law as well as of the Polish constitution. This level of political interference with the judiciary can only lead to decreased trust in the fairness of trials

Another amendment adopted on 12 July by parliament involves the law on Common Courts and changes the nominations of the presidents and vice-presidents of the common courts. The decisive role in this process is now with the Minister of Justice. That means one man can select who is to be a judge, not a panel, not a discussion group, only ONE man. This does not seem democratic to me.

After that conversation Joan and I went for a walk in the center, without camera. That was a mistake because one of the old churches that I have wanted to take pictures of inside just happened to be open as we passed by. However, without camera, no pictures :-(

Miałem ciekawą rozmowę z Czesławem, mężczyzną, który głosował na partię PiS w ostatnich wyborach. Powiedział, że teraz obawia się, że popełnił błąd. Strach wynika z przyjętego wczoraj przez polski parlament najnowszego ustawodawstwa, co może doprowadzić do zakończenia niezależności sądownictwa w kraju.

To stwarza duże zagrożenie dla prawa i wolności w Polsce. Prawo do sprawiedliwego procesu jest jednym z głównych wymogów międzynarodowego prawa dotyczącego praw człowieka, a także polskiej konstytucji. Ten poziom politycznej ingerencji w sądownictwo może prowadzić jedynie do zmniejszenia zaufania do uczciwości procesu w sądzie.

Kolejna poprawka przyjęta dnia 12 lipca przez parlament obejmuje prawo dotyczące sądów powszechnych i zmienia nominacje prezesów i wiceprzewodniczących sądów powszechnych. Decydującą rolę w tym procesie odgrywa obecnie  Minister Sprawiedliwości. Oznacza to, że nie grupa i nie po dyskusji, a jeden człowiek może zdecydować, kto ma być sędzią. Tylko jeden człowiek. Nie wydaje mi się, aby to było demokratyczne.

Po tej rozmowie Joanna i ja poszliśmy na spacer do centrum, tym razem bez aparatu fotograficznego. To był błąd, ponieważ jeden ze starych kościołów, którego wnętrze chciałem sfotografować, właśnie był otwarty, kiedy go mijaliśmy. Ne ma aparatu fotograficznego, nie ma zdjęć :-(

    hi David and Joan, I will let you know a little secret, all governments of all countries in all times have nominated there own to fill important administrative positions like appointing Judges etc, this is another scare tactic employed by PO and the like to discredit a very good government, You are not telling me that all judges are corrupt?.. Talk of no free speech, people put into prison for speaking out, makes me just laugh and confirms my belief that there is always a fool in every crowd, some people call them black sheep, others say that they are the ones who came down in the last shower.. David and Joan do you feel threatened by this government, do you double lock your doors and speak in whispers afraid that you are being monitored.

  2. Not yet.......but when one man, the Minster of Justice by all names, or the Parliament, controlled by PiS have control of the Justice system, you should be worried also. Is that democracy?
